Terms and Conditions

Big League Tours, Inc.

On payment of the Deposit, defined below, the depositor and any travel companion of depositor (collectively, "Travelers") agree to be bound by the following terms and conditions (collectively, "Terms").

General Terms
Big League Tours, Inc. ("Big League Tours") and its affiliates and sponsoring representative(s) (collectively, its "Representatives") are acting solely as intermediaries. Big League Tours and its Representatives are responsible only for making the arrangements for all accommodations, services, and events that constitute the trip, except to the extent that accommodations or services cannot be supplied due to reasons beyond the control of Big League Tours or its Representatives, as detailed in these Terms. The carriers, motor coach companies, hotels, and other suppliers ("Suppliers") providing travel, hotel, and other accommodations are independent contractors and not agents or employees of Big League Tours or its Representatives.

Big League Tours' website may contain hyperlinks, from time to time, to websites operated by parties other than Big League Tours. Such hyperlinks are provided for Travelers' reference only. Big League Tours does not control such websites and is not responsible for their contents or Travelers' use of them. Big League Tours' inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with those operators or Suppliers.

Big League Tours is not affiliated with any sports team or league.

Payment
Big League Tours requires a $1,000 deposit per Traveler at the time of booking in order to make the reservation (the "Deposit"). The final payment is due 120 days prior to the confirmed arrival date.

Notice
Any notice required to be given under these Terms shall be sent to the address for Big League Tours located on its website, or to Travelers at the address given to book the tour, via overnight delivery with return receipt through a nationally recognized carrier. Notwithstanding the foregoing, written notice of cancellation under the "Cancellations and Refunds" section below may also be delivered by email to the address designated by Big League Tours for that purpose. Any notice under these Terms is effective upon actual receipt, and the date of receipt (not the date sent) shall be used to determine any applicable deadline or cancellation fee under these Terms.

Cancellations and Refunds
Big League Tours requires written notification of cancellation pursuant to the Notice section above. Cancellations received 121 days or more prior to the confirmed arrival date are eligible for a full refund. Cancellations received 91-120 days prior to the confirmed arrival date are subject to a cancellation fee equal to the Deposit. Cancellations received 61-90 days prior to the confirmed arrival date are penalized at 50% of the total tour cost. Cancellations received less than 60 days prior to the confirmed arrival date are penalized at 100% of the total tour cost.

This cancellation fee schedule applies to cancellations initiated by a Traveler for any reason within that Traveler's control. It does not apply to cancellations resulting from a Force Majeure Event, including a Work Stoppage, which are governed exclusively by the Force Majeure section below. Big League Tours regrets that it cannot make exceptions to this fee schedule for personal emergencies, and recommends that Travelers consider purchasing tour cancellation insurance.

If one or more Travelers cancels their trip and such cancellation alters the room requirements of the remaining Travelers, Travelers still traveling may be required to pay a revised rate.

All travel documents, if issued, must be returned to Big League Tours prior to any refund being issued.

There shall be no refunds given for any unused travel services or any portion thereof.

Big League Tours reserves the right to cancel any tour prior to departure for any reason, including insufficient enrollment or operational or cost circumstances that make the tour impracticable to operate (a "Company Cancellation"). In the event of a Company Cancellation, Big League Tours will use commercially reasonable efforts to offer affected Travelers the option to transfer their payments to another Big League Tours tour within the same Tour Season (defined below). If Big League Tours is unable to offer a suitable alternative tour, or if a Traveler does not wish to transfer, that Traveler will receive a refund of the Deposit and any other payments made to Big League Tours for that tour. This paragraph does not apply to cancellations resulting from a Force Majeure Event, which are governed exclusively by the Force Majeure section below. Big League Tours is not responsible for any payments made by a Traveler to other entities, such as airlines, car services, or travel agents.

"Tour Season" means, for a given league or sport featured on a Big League Tours tour, the period encompassing that league's regular season and any postseason competition for a given year, as scheduled by the applicable league.

Force Majeure
Big League Tours and its Representatives' performance under these Terms may be excused by any event or occurrence beyond their reasonable control, including but not limited to: acts of God; war or threat of war; government retaliation against foreign or domestic enemies; terrorism; government regulation or shutdown; executive order; civil disorder; recognized health threats as determined by the World Health Organization, the Centers for Disease Control, or a local health agency; disaster; fire; strikes, either real or threatened; curtailment of transportation facilities; a Work Stoppage (as defined below); or any other cause beyond the reasonable control of Big League Tours or its Representatives that makes performance of the tour illegal, inadvisable, or impossible on an economic, political, or personal-safety basis (a "Force Majeure Event"). Big League Tours and its Representatives have no liability, and no obligation to make a refund, if a Force Majeure Event occurs, except as expressly set forth below.

Work Stoppages
A labor dispute, strike, lockout, or other work stoppage involving a professional sports league, team, or players' association that affects the games or events included in a tour (a "Work Stoppage") constitutes a Force Majeure Event under these Terms. If a Work Stoppage affects a tour, Big League Tours will use commercially reasonable efforts to (a) rebook affected Travelers on the same or an alternative Big League Tours tour within the same Tour Season, or (b) issue affected Travelers a credit toward a future Big League Tours tour, valid through the end of the Tour Season immediately following the Tour Season affected by the Work Stoppage. No refunds will be issued in connection with a Work Stoppage, whether or not Big League Tours is able to provide a rebooking or credit under this section.

Documentation and Personal Identification
It is the responsibility of each individual Traveler to obtain the documentation required for their trip, such as passports, visas, birth certificates, and photo identification. Travelers entering the United States and Canada are required to show proof of citizenship for entry. Travelers denied entry at any border are not entitled to any refund.

Hotel Accommodations
Travelers agree to be responsible for all incidental charges incurred in excess of those covered by the package. Incidental charges can include food, beverages, telephone use, internet use, parking fees, and other hotel charges. All hotels require a credit card or deposit for incidental charges at check-in. Hotels expect departing guests to vacate rooms by 12:00 noon and arriving guests not to check in before 3:00 p.m., to allow for cleaning and maid service. Host hotels do their best to minimize inconvenience and to store luggage if a Traveler arrives early or must depart late. Big League Tours reserves the right to substitute confirmed hotels with comparable accommodations at its own or the hotel's discretion. Accommodations are subject to availability.

Credit Card Payments
A Traveler's verbal or written authorization to charge their credit card for the Deposit and/or final payment constitutes that Traveler's acceptance of, and agreement to be bound by, these Terms, and confirms the Traveler's reservation.

Photograph Release
Travelers permit and authorize Big League Tours and its employees, agents, and personnel acting on behalf of Big League Tours to use photographs or other likenesses of Travelers and those in a Traveler's party for purposes related to the publicity, marketing, and promotion of Big League Tours and its tours, events, and programs.

A Traveler's photograph or likeness may be copied and distributed by means of various media, including video presentations, television, news bulletins, mailouts, billboards or signs, brochures, placement on Big League Tours' and other websites, social media, or newspapers.

Although Big League Tours will endeavor to use a Traveler's photograph or likeness in accordance with standards of good judgment, Big League Tours cannot warrant or guarantee that any further dissemination of a Traveler's photograph or likeness will be subject to Big League Tours' supervision or control. Accordingly, Travelers release Big League Tours from any and all liability related to the dissemination of their photographs or likeness.

Disclaimer of Warranties
The information, products, and services published on Big League Tours' website may include inaccuracies or typographical errors. In particular, Big League Tours and its Representatives do not guarantee the accuracy of, and disclaim liability for inaccuracies relating to, the information and description of the tour packages and trips, with respect to the hotel, air, car, and other travel products displayed on the website (including, without limitation, photographs, if any, lists of hotel amenities, general product descriptions, etc.), much of which information is provided by the respective Suppliers. Big League Tours and its Representatives may make improvements and/or changes to the information provided at any time, in their sole discretion.

Big League Tours and its Representatives make no representations about the suitability of the information, products, and services provided for any purpose. All information, products, and services are provided “as-is” without warranty of any kind. Big League Tours and its Representatives hereby disclaim all warranties and conditions with respect to such information, products, and services, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title, and noninfringement, to the fullest extent allowable by law.

Limitation of Liability
IN NO EVENT WILL BIG LEAGUE TOURS BE LIABLE TO ANY TRAVELER FOR ANY INDIRECT, SPECIAL, EXEMPLARY, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO ANY TOUR OR THESE TERMS, EVEN IF BIG LEAGUE TOURS KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. BIG LEAGUE TOURS' TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO ANY TOUR OR THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, WILL NOT EXCEED THE AMOUNT OF FEES ACTUALLY PAID TO BIG LEAGUE TOURS BY THE TRAVELER WHO BRINGS THE CLAIM OR ALLEGES THE LIABILITY. THE PARTIES ACKNOWLEDGE THAT THESE TERMS REFLECT THE ALLOCATION OF RISK SET FORTH IN THIS AGREEMENT, AND THAT THE PARTIES WOULD NOT ENTER INTO THIS AGREEMENT WITHOUT THESE LIMITATIONS OF LIABILITY. BIG LEAGUE TOURS AND ITS REPRESENTATIVES ARE NOT LIABLE FOR THE NEGLIGENCE OR WILLFUL MISCONDUCT OF ANY SUPPLIER OR THIRD PARTY PROVIDING SERVICES ON A TOUR, OR FOR ANY PERSONAL INJURY, DEATH, PROPERTY LOSS, OR OTHER DAMAGES RESULTING THEREFROM.

Indemnification
Each Traveler shall indemnify, defend, and hold harmless Big League Tours from and against all damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of any claim, suit, dispute, or proceeding arising from or relating to (a) a breach of these Terms by any Traveler; (b) the actions or omissions of a Traveler during a tour; or (c) any property damage or personal injury caused during the course of a tour, whether such damage or injury pertains to another traveler on the tour, a Supplier, or any other third party.

Governing Law
These Terms and the relationship between Big League Tours, its Representatives, and Travelers shall be governed by Indiana law, and any claim related to any tour or these Terms shall be brought in a court of competent jurisdiction located in Marion County, Indiana. The prevailing party in any dispute shall be entitled to all costs, expenses, and fees (including attorneys' fees) incurred in connection with the dispute, regardless of whether a lawsuit is filed. TRAVELERS EXPRESSLY AGREE TO SUBMIT TO PERSONAL JURISDICTION IN MARION COUNTY, INDIANA, AND TRAVELERS WAIVE ANY RIGHT TO A TRIAL BY JURY FOR ANY DISPUTE RELATED TO ANY TOUR, ANY PAYMENT MADE FOR A TOUR, OR THESE TERMS.

Acknowledgement
Travelers agree that each has read and fully understands these Terms, which serve as a binding contract between Travelers and Big League Tours. Big League Tours reserves the right to change these Terms in its sole discretion, effective upon posting the amended Terms on Big League Tours' website or upon written notice to Travelers, and Travelers agree to accept and be bound by those amended Terms.
